Introduction

Welcome to The Smart Innovator™ (“Company,” “we,” “our,” or “us”). These Terms of Use (“Terms”) govern your access to and use of our website https://thesmartinnovator.com (the “Site”), mobile services, newsletters, subscriptions, and any related features (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you must not use our Services.

Definitions

• Services: The Site, content, tools, newsletters, personalized features, and any subscription or membership services offered by The Smart Innovator.
• User/You: Any person or entity who accesses or uses the Services.
• Member/Subscribers: Users who pay or sign up for membership, subscription, or contribution plans, including through the Google Reader Revenue program.

1. Eligibility

You must be at least 16 years old (or the minimum legal age in your country) to use our Services. By using the Services you confirm you have the legal capacity to enter into these Terms.

2. Changes to Terms

We may update these Terms periodically. If we make material changes, we will notify you by posting the updated Terms on the Site and, where practicable, via email to account holders. Continued use of the Services after publication of changes constitutes acceptance of the revised Terms.

3. Services We Provide

We offer editorial content (articles, reviews, analysis), newsletters, personalized content recommendations, and subscription/membership products and services. We may participate in programs such as the Google Reader Revenue program to enable paid subscriptions, contributions, and memberships.

4. Accounts & Registration

Certain features require an account. You agree to provide accurate information and to keep your account credentials secure. You are responsible for all activity that occurs under your account and must notify us immediately of any unauthorized use.

5. Subscriptions, Payments & Cancellations

Some Services are paid. Payment terms, pricing, billing intervals, and renewal rules will be displayed at purchase:

• Payment processing: Payments are processed by trusted third-party payment providers (e.g., Google Payments, Stripe, PayPal). We do not store full card details on our servers.
• Auto-renewal: Unless stated otherwise, subscriptions auto-renew until cancelled.
• Cancellation: You can cancel via your account dashboard or by contacting support. Cancellation takes effect at the end of the current billing period unless otherwise described.
• Refunds: Refunds, where applicable, will be handled per the refund policy shown at purchase and in accordance with applicable law (for example, EU/UK 14-day consumer withdrawal rights where applicable).

6. Personalized Experience & Data Use

We use cookies, tracking technologies, and information you provide to personalize recommendations, newsletters, and your overall experience. Personalization settings are available in your account preferences. Personal data use is governed by our Privacy Policy, and we will comply with applicable data protection laws including GDPR and CCPA.

7. Acceptable Use

You are responsible for what you submit and warrant that you have rights to submit it and that it does not violate any law or third-party rights. We may remove content that violates these Terms.

9. Intellectual Property

All Site content, trademarks, logos, graphics, and code are owned or licensed by The Smart Innovator and protected by copyright, trademark and other intellectual property laws. You may not copy, republish, or use content other than for personal, non-commercial purposes without our prior written permission.

10. Third-Party Links & Services

The Site may include links to third-party websites or services. We do not endorse and are not responsible for third-party content, products, or policies. Your interactions with third parties are solely between you and the third party.

11. Disclaimers

The Services are provided “as is” and “as available”. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the Site will be uninterrupted or error-free.

12. Limitation of Liability

To the maximum extent permitted by law, in no event will The Smart Innovator, its affiliates, officers, directors, employees, agents, or partners be liable for any indirect, incidental, special, punitive, or consequential damages, or for loss of profits, revenue, data, or goodwill arising out of or in connection with your use of the Services. Our total liability for direct damages arising out of or related to these Terms will not exceed the amount paid by you to us in the twelve (12) months preceding the claim, or a nominal amount if you have not paid us.

13. Termination

We may suspend, restrict, or terminate your access to the Services at any time for violations of these Terms, suspected fraud, non-payment, or legal reasons. Upon termination, you must stop using the Services and any licenses granted to you will end.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws indicated below depending on your location. If your local consumer protection law mandates otherwise, that law will apply to the extent required.

• India: Indian law; courts of [Your City, India].
• United States: State law of [Insert State]; courts in [Insert City/State].
• UK & EU: Local consumer protection and data protection laws apply; disputes handled per applicable rules.

Where permitted by law, disputes may be resolved through binding arbitration instead of court litigation, and users may be asked to waive the right to a jury trial and class actions (see Section 17).

15. Region-Specific Rights

15.1 India

We comply with the Information Technology Act, 2000 and applicable Indian consumer protection laws. Users should not publish content that is obscene, defamatory or illegal under Indian law.

15.2 United States

Certain US states (e.g., California) provide additional rights such as those under the CCPA. Where applicable, those rights govern the processing of personal data.

15.3 United Kingdom & European Union

16. Indemnification

You agree to indemnify, defend and hold harmless The Smart Innovator and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Services, breach of these Terms, or violation of any rights of a third party.

17. Waiver of Certain Rights

No Jury Trial

You and The Smart Innovator each hereby waive any right to a jury trial of any controversy, claim, counterclaim, or other dispute arising between you and The Smart Innovator relating to these Terms or the Site (each a “Claim,” and collectively, “Claims”).

No Class Representative or Private Attorney General

With respect to any Claim, neither you nor The Smart Innovator may: (i) act as a class representative or private attorney general; or (ii) participate as a member of a class of claimants. You agree that neither you nor The Smart Innovator may litigate (or seek to litigate) any Claim on a class or representative basis, and that you and The Smart Innovator may seek relief only through individual Claims. You and The Smart Innovator may not consolidate or join (or seek to consolidate or join) any controversy, claim, counterclaim, or other dispute of other persons or parties who may be similarly situated.

Severability / No Waiver / Survival

If any provision of this section (Waiver of Certain Rights) is found to be invalid or unenforceable, that provision will be deemed modified to give effect to the parties’ intent or, if modification is not possible, will be severed and the remainder of this section will continue in full force and effect. No waiver of any provision of this section will be effective or enforceable unless recorded in a writing signed by the party waiving such a right or requirement. Such a waiver will not waive or affect any other provision of these Terms. This section will survive the termination of your relationship with The Smart Innovator.

30-Day Opt-Out Right

You have the right to opt out of the provisions of this section by sending, within 30 days after first becoming subject to its terms, written notice of your decision to opt out to the following address:

Your notice must include your name and address, any usernames, each email address you have used to set up an account on the Services, and an unequivocal statement that you want to opt out of this section. If you opt out, all other parts of these Terms will continue to apply. Opting out of this section does not affect other agreements you may have with us.

Limitations

This section limits certain rights, including the right to maintain certain court actions, the right to a jury trial, the right to participate in any form of class or representative claim, and the right to certain remedies and forms of relief.

18. Severability, Waiver & Survival

If any provision of these Terms is held invalid or unenforceable, the remainder of the Terms will continue in effect. No waiver of any right under these Terms shall be effective unless made in writing and signed by an authorized representative of The Smart Innovator. Provisions that by their nature should survive termination will survive.

19. Notices

We may provide notices by email, posting on the Site, or other means as required by law. You are responsible for keeping your contact information up to date.

20. Children

Our Services are not intended for children under the age of 16. If you are a parent or guardian and believe a child under 16 has provided us personal data without your consent, contact us at support@thesmartinnovator.com.

20. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms provided at the time of purchase, constitute the entire agreement between you and The Smart Innovator regarding the Services.
